Divorce & Property Sharing: Does a Deed of Trust Actually Help?
There is usually a particular moment during difficult marriages when one spouse suddenly develops a deep spiritual interest in “asset protection.”
That is often the exact moment phrases like:
“Put the house in a trust,”
“Register it in my mother’s name,” or
“Technically it’s not mine,”
begin circulating in family WhatsApp groups with alarming confidence.
But legally speaking, the real question is this:
Can a Deed of Trust actually protect property during divorce proceedings in Zimbabwe?
The answer is:
Sometimes yes. Sometimes absolutely not.
A trust can legitimately protect assets in certain circumstances.
However, courts are not blind to arrangements created purely to defeat a spouse’s claim during divorce proceedings.
If a property was acquired during the marriage, improved through joint effort, or effectively controlled and enjoyed by one spouse despite being placed in a trust, the court may still closely examine:
- who funded the property,
- who benefited from it,
- when the trust was created,
- and whether the trust is genuine or merely a convenient legal costume.
Because contrary to popular belief:
a Deed of Trust is not an invisibility cloak from the Matrimonial Causes Act.
Zimbabwean courts generally focus heavily on:
- contributions by spouses,
- fairness,
- welfare of children,
- financial realities,
- and the true substance of ownership not merely what appears on paper.
So while trusts can be useful for:
- estate planning,
- succession,
- business continuity,
- asset management,
- and legitimate family wealth structuring,
they are not guaranteed immunity from scrutiny during divorce litigation.
And let us be honest:
some people only discover the concept of trusts approximately 14 business days before filing for divorce.
The law, however, tends to notice these things.
